Правове регулювання бюджетного контролю в Україні

Abstract

Дисертація є науковим дослідженням правового регулювання бюджетного контролю. У дисертації проаналізовано історичні аспекти виникнення, становлення та розвитку правових вчень про бюджетний контроль та виокремлено три періоди. Розглянуто наукові погляди щодо визначення поняття бюджетного контролю, обґрунтовано доведено необхідність уніфікації бюджетно-правової термінології та запропоновано авторське визначення бюджетного контролю. Запропоновано концептуальні засади правового регулювання бюджетного контролю. Визначено види, форми та методи бюджетного контролю, представлено їх авторську класифікацію, надано їх правову характеристику. Досліджено моделі організації бюджетного контролю в Україні та зарубіжних країнах, виявлено позитивний досвід зарубіжних країн та запропоновано його впровадження в Україні. Обґрунтовано запропоновано визнати четверту модель – суспільну модель бюджетного контролю та громадський фінансовий контроль – видом бюджетного контролю. Визначено та охарактеризовано форми громадського бюджетного контролю. Розглянуто питання уніфікації, оптимізації та стандартизації бюджетного контролю. Запропоновано напрями удосконалення бюджетного законодавства та поточні зміни і доповнення до нього.

The dissertation is a scientific research of the legal regulation of budget control in Ukraine. The analysis of the historical aspects of arising, establishment and development of legal studies on budget control has been made and three stages have been singled out. The scientific approaches as for the definition of the budget control have been considered; the grounds for argumentation of the necessity of the budget-legal terminology unification have been given, and the author’s definition of the budget control has been suggested in the dissertation. The conceptual foundations of legal regulation of the budget control have been considered. The types, forms and methods of the budget control have been determined, the author’s classification of them as well as their legal characteristics have been analyzed. The models of the organization of the budget control both in Ukraine and abroad have been investigated; a positive experience of the foreign countries has been revealed and suggested for the implementation in Ukraine. It has been argumentatively proved that the fourth model -social model of the budget control and public budget control – should be recognized as the type of budget control.The forms of public budget control have been determined and characterized. The problems of unification, optimization and standardization of the budget control have been considered. The directions of improvement of the budget legislation and current changes and amendments have been suggested.
