Міська правова система в Україні: загальнотеоретичне дослідження

Abstract

Дисертація присвячена міській правовій системі як сучасній формі існування міського права. Доведено актуальність урбаністичного підходу як складової методології юриспруденції. Виявлено співвідношення міського та муніципального права, розкрито ціннісно-нормативні аспекти розвитку міського права. Показано роль міст у структурі державного простору шляхом використання концепції центр-периферійних відносин. Продемонстровано, що залежно від ролі міст держави поділяються на моноцентричні та поліцентричні. Виявлено структуру міської правової системи. Суб’єктна підсистема виражена в інститутах прав і свобод городян, а також правосуб’єктності міста. Нормативна підсистема пов’язана з формуванням системи джерел міського права. Інституційна підсистема виражена в існуванні нормативних, організаційних та функціональних інститутів. Комунікативна підсистема знаходить своє вираження в правових комунікаціях городянин-місто, місто-місто та держави щодо міста. Ідеологічна підсистема міської правової системи пов’язана зі специфікою міської правосвідомості. Надано характеристику правовим системам трьох українських міст – Києва, Львова та Одеси. Показано, що підставою для формування правових систем у них стали різні фактори: для м. Києва – це столичний статус, для м. Львова – необхідність збереження культурної спадщини, для м. Одеси – ідеологія багатокультурності.

The thesis is devoted to the urban legal system as a modern form of existence of urban law. The relevance of the urban approach as part of the methodology of jurisprudence is grounded. Author discovers the correlation between urban and municipal law, reveals the value-normative aspects of urban law development. The role of cities in the structure of public space is shown by using the theory of center-peripheral relations. It is demonstrated that depending on the role of cities in the states they are divided into monocentric and polycentric. The structure of the urban legal system is revealed. Status subsystem is expressed in institutes of the rights and freedoms of citizens and in legal personality of city. Normative subsystem is associated with the formation of the system of sources of urban law. Institutional subsystem is expressed in the existence of legal, institutional and functional institutes of urban law. Communicative subsystem is reflected in legal communications citizen-city, city-city and states about cities. Ideological subsystem of urban legal system is related to the specific urban legal consciousness. Author gives the characteristic of legal systems of three Ukrainian cities – Kyiv, Lviv and Odessa. It is shown that the basis for the formation of the legal systems can be different: for Kyiv that is the capital status of the city; for Lviv – the necessity of preservation of cultural heritage, for Odessa – the ideology of multiculturalism.
