Проблеми імплементації базових європейських екологічних понять у водне законодавство України

Abstract

У статті досліджено співробітництво України та ЄС із питань охорони навколишнього середовища, а саме проблеми імплементації в українське екологічне законодавство базових еколого-правових категорій і визначень законодавства ЄС. Проаналізовано перші кроки співпраці у сфері «якість води й управління водними ресурсами». Зазначено, що ця діяльність почалася не з гармонізації базових понять, до яких належать «забруднення», «забруднюючі речовини», «якість води», а одразу перейшла на рівень еколого-правових інститутів. Виявлено, що такий перехід ігнорує принципові відмінності в понятійних засадах, які можуть негативно вплинути на здійснення державної політики у сфері охорони вод, спричинити її дивергентний розвиток відносно європейських вимог. Стверджується, що подолання змістовних відмінностей згаданих понять є однією з головних наукових проблем апроксимації Водного кодексу України (ВКУ) та відповідних підзаконних актів до Директиви 2000/60/ЄС (ВРД). Метою статті є виявлення правових відмінностей між ВРД і ВКУ щодо зазначених понять, а завданням – аналітичне порівняння їх застосування. Дослідження ґрунтувалося на тому, що норми стосовно забруднення та якості вод утворюють у водному законодавстві України та в екологічному законодавстві ЄС еколого правові структури, європейським центром яких є ВРД. Доведено, що принципові відмінності між базовими поняттями водних законодавств ЄС й України щодо забруднення, забруднюючих речовин, якості вод і її регулювання визначаються різною цільовою спрямованістю цих законодавств, водоохоронною й господарською відповідно. Досліджено деякі наслідки розбіжностей, які негативно позначаються на законодавчому регулюванні скидання забруднюючих речовин. Зроблено висновок, що усунення відмінностей вимагає зміни парадигми української охорони вод з господарської на екологічну, яку слід починати з рецепції зазначених базових понять ЄС. Альтернативою глибокій зміні ВКУ може стати розроблення й прийняття спеціального Закону України «Про охорону вод».

The article explores the cooperation between Ukraine and the EU on environmental issues, namely the problems of implementation of basic ecological legal categories and definitions of EU legislation into the Ukrainian environmental legislation. The first steps of cooperation in the field of “water quality and water management” are analyzed. But this activity did begin not with the harmonization of basic concepts, which include “pollution”, “polluting substances”, “water quality”, and immediately passed to the level of environmental legal institutions. Such a transition was found to ignore fundamental differences in conceptual principles that could adversely affect the implementation of state water policy and cause its divergent development with relation to European requirements. It is argued that overcoming the substantive differences between these concepts is one of the major scientific problems for approximation of the Water Code of Ukraine (WCU) and the relevant by-laws to Directive 2000/60 / EC (WFD). The purpose of the article is to identify the legal differences between the WFD and the WCU in respect of given above concepts, and the task is to analytically compare their application. The study proceeded from the fact that in the water legislation of Ukraine and in the EU environmental legislation, the rules on pollution and water quality form environmental legal structures, the European center of which is the WFD. It is proved that the fundamental differences between the basic notions of EU and Ukrainian water legislation on pollution, pollutants, water quality and its regulation are determined by different targeting of these laws: water protection and water use respectively. Some implications of the differences that have a negative impact on the legislative regulation of the discharge of pollutants have been investigated. It is concluded that the elimination of differences requires a change in the paradigm of Ukrainian water protection from economic to environmental, which should start with the reception of EU basic notions given above. An alternative to a profound change in the WCU may be the development and adoption of a special Law of Ukraine “On Water Protection”.
