Кримінально-правова охорона конституційного ладу та державної влади в системі кримінально-правової політики України

Abstract

Стаття присвячена дослідженню кримінально-правової охорони конституційного ладу та державної влади України як складової частини сучасної кримінально-правової політики. Визначено, що сучасна кримінально-правова політика України та її реалізація залежить від впливу об’єктивних чинників, вдосконалення якої повинно засновуватися на розумінні її основних векторів, серед яких кримінально-правова охорона конституційного ладу та державної влади посідає першочергове місце. На основі наведених наукових концепцій проаналізовано сутність злочинів проти основ національної безпеки України у вітчизняному кримінальному праві та визначено роль, місце злочинів, основною метою яких є посягання на конституційний лад та державну владу. Визначено основні умови, які впливають на розуміння відповідних видів злочинів у рамках злочинності проти основ національної безпеки України в аспекті їх кримінально-правової характеристики та особливості взаємодії з передбаченими чинним кримінальним законодавством України. Доведено, що кримінально-правова охорона конституційного ладу та державної влади є основною складовою частиною реалізації сучасної кримінально-правової політики України, та визначено місце ст. 109 КК України в як кримінально-правової гарантії охорони конституційного ладу та державної влади в Україні. Представлено авторське розуміння дій, спрямованих на насильницьку зміну чи повалення конституційного ладу або на захоплення державної влади в Україні. У висновках обґрунтовано основоположну роль кримінально-правової охорони конституційного ладу та державної влади в Україні та представлені шляхи вдосконалення ст. 109 КК України.

The article is devoted to the study of criminal law protection of the constitutional order and state power in Ukraine as a component of modern criminal legal policy of Ukraine. It is determined that the modern criminal law policy of Ukraine and its implementation depends on the influence of objective factors, the improvement of which should be based on understanding its main vectors, among which the criminal law protection of the constitutional order and state power is currently paramount. Based on the existing scientific concepts, the essence of crimes against the foundations of national security of Ukraine in domestic criminal law is analyzed and the role and place of crimes, the main purpose of which is to encroach on the constitutional order and state power, is determined. The main conditions that affect the understanding of the relevant types of crimes in the framework of crime against the foundations of national security of Ukraine in terms of their criminal characteristics and features of interaction with the current criminal legislation of Ukraine. It is proved that the criminal law protection of the constitutional order and state power is the main component of the implementation of the modern criminal law policy of Ukraine and the place of Art. 109 of the Criminal Code of Ukraine as a criminal-legal guarantee of protection of the constitutional order and state power in Ukraine. The author’s understanding of actions aimed at forcible change or overthrow of the constitutional order or the seizure of state power in Ukraine is presented. In the framework of the study of criminal law protection of the constitutional order and state power in Ukraine, attention is paid to the peculiarities of understanding the categories constitutional order and state power in the aspect of science of criminal law of Ukraine. authorities. The conclusions substantiate the fundamental role of criminal law protection of the constitutional order and state power in Ukraine and present ways to improve Article 109 of the Criminal Code of Ukraine.
