Combating corruption in sport: Legal aspect

Abstract

Globalization processes do not ignore any sphere of human life. They did not miss the field of sports. As a result,the problem of corruption, which used to be unequally prevalent in every national jurisdiction, is beginning to threaten theintegrity of sport at the global level. Therefore, legal science has a task to determine the legal algorithms for combating sportscorruption both within the country and in the international arena. The study aims to establish legal mechanisms to combatcorruption in sports at both national and international levels. The object of research is public relations in the field of sports law.The subject of the study is public relations in the field of sports law, which have developed concerning methods and means ofcombating sports corruption. The research methods were philosophical, general scientific, and special scientific methodssuch as dialectical, system-structural, comparative-legal, and formal-legal methods. As a result of the work, a description ofthe state of research of the problem was given, the main approaches to defining the concept of sports corruption and match-fixing were analyzed, the legal framework (international and national) was characterized, specific examples of corruptionoffenses and their solution in sports were given.

Глобалізаційні процеси не залишають поза увагою жодну сферу життя людини. Не оминули і спортивну сферу. Як наслідок, проблема корупції, яка раніше була неоднаково поширена в кожній національній юрисдикції, починає загрожувати цілісності спорту на глобальному рівні. Тому перед юридичною наукою стоїть завдання визначити правові алгоритми боротьби зі спортивною корупцією як всередині країни, так і на міжнародній арені. Метою дослідження є створення правових механізмів боротьби з корупцією у спорті як на національному, так і на міжнародному рівнях. Об'єктом дослідження є суспільні відносини у сфері спортивного права. Предметом дослідження є суспільні відносини у сфері спортивного права, що склалися щодо методів і засобів боротьби з корупцією у спорті. Методами дослідження були філософські, загальнонаукові та спеціальнонаукові методи: діалектичний, системно-структурний, порівняльно-правовий, формально-правовий. За результатами роботи надано характеристику стану дослідження проблеми, проаналізовано основні підходи до визначення поняття спортивної корупції та договірних матчів, охарактеризовано нормативно-правову базу (міжнародну та національну), наведено конкретні приклади корупційних правопорушень та їх вирішення у спорті.
