Правова комплементарність: інноваційний науковий концепт поєднання «духу» і «букви» у правовій реальності

Abstract

У статті обґрунтовується концепт правової комплементарності як ключового інтегративного інструменту, що забезпечує органічну єдність «духу» та «букви» в сучасній правовій реальності. Автор доводить, що традиційний дуалізм природного та позитивного права постає штучним бар’єром, позбавленим належного суспільного запиту. Натомість пропонується розглядати «дух» (ціннісний вимір) і «букву» (формально-нормативний вимір) не лише як допоміжні засоби правового тлумачення, а як самостійні, взаємозалежні теоретико-правові категорії, що перебувають у стані постійної синергії. Особливу увагу приділено змістовно-методологічним засадам подолання асиметрії між правовою нормою та її ціннісним наповненням -правовій комплементарності, якій надано авторське визначення. Відтак дослідження ґрунтується на твердженні, що формальна правова норма набуває належної легітимності та реальної дієвості лише за умови її аксіологічного осмислення. За відсутності ціннісного наповнення закон неминуче зазнає деградації, трансформуючись або в інструмент легалізованого свавілля, або в декларативне «гасло», позбавлене реального впливу на суспільні відносини. Запропонований підхід уможливлює трансформацію «сухого філологічного фіксування» тексту у якісно новий вимір правової реальності, в межах якого правовий припис постає «справедливим за суттю». Інноваційність дослідження полягає у формуванні методології, що поєднує лінгвістичний аналіз нормативного тексту з його глибинним аксіологічним виміром. Такий підхід забезпечує перехід від вузького формально-юридичного розуміння права до його розширеної, людиноцентричної інтерпретації. Автор обґрунтовує, що саме синергетичний ефект правової комплементарності слугує підґрунтям для забезпечення об’єктивної правової імперативності та реальної, а не декларативної легітимності як правової системи загалом, так і її окремих галузей. У цілому комплементарність «нерукотворного права» та «рукотворного» закону сприяє відновленню «дійсного обличчя» права, за яким «буква» і «дух» існують у нерозривній єдності, забезпечуючи реалізацію принципів соціальної справедливості та благ людини. Такий підхід розглядається як необхідна передумова еволюції сучасного правового регулювання в умовах глобальних викликів, а також як важливий чинник зміцнення верховенства права та підвищення його ефективності.

The article substantiates the concept of legal complementarity as a key integrative instrument that ensures the organic unity of the “spirit” and the “letter” within contemporary legal reality. The author argues that the traditional dualism between natural law and positive law constitutes an artificial barrier lacking sufficient societal demand. Instead, it is proposed to consider the “spirit” (the axiological dimension) and the “letter” (the formal-normative dimension) not merely as auxiliary tools of legal interpretation, but as autonomous and interdependent theoretical-legal categories existing in a state of continuous synergy. Particular attention is devoted to the substantive and methodological foundations for overcoming the asymmetry between the legal norm and its value content – namely, legal complementarity, for which an original authorial definition is proposed. Accordingly, the study is grounded in the premise that a formal legal norm attains proper legitimacy and real effectiveness only when it is subject to axiological interpretation. In the absence of value content, the law inevitably undergoes degradation, transforming either into an instrument of legalized arbitrariness or into a declarative “slogan” devoid of any real impact on social relations. The proposed approach enables the transformation of the “dry philological fixation” of the text into a qualitatively new dimension of legal reality, within which the legal provision emerges as “just in its essence”. The novelty of the study lies in the development of a methodology that integrates linguistic analysis of the normative text with its deeper axiological dimension. Such an approach facilitates a shift from a narrow, formalistic understanding of law to its broader, human-centered interpretation. The author substantiates that the synergistic effect of legal complementarity serves as a foundation for ensuring objective legal imperativity and genuine, rather than merely declarative, legitimacy of both the legal system as a whole and its individual branches. Overall, the complementarity of “divine law” and “man-made” law contribute to restoring the “true face” of law, wherein the “letter” and the “spirit” exist in inseparable unity, ensuring the realization of the principles of social justice and human well-being. This approach is regarded as a necessary precondition for the evolution of contemporary legal regulation in the context of global challenges, as well as an important factor in strengthening the rule of law and enhancing its effectiveness.
