І. Малиновський і становлення радянського пенітенціарного права

Abstract

У статті розглянуто питання про умови та час створення перших радянських виправно-трудових Кодексів, зокрема ВТК РРФСР, про участь І. Малиновського в науковому обговоренні його проєкту й науково-експертній оцінці вже прийнятого ВТК тоді, коли сам він був в’язнем. Причиною зародження та становлення нового радянського права, зокрема права кримінальновиконавчого, науковець називав революцію 1917 року, руйнацію старого суспільного ладу і старого права. Новий суспільний лад вимагав адекватного йому права. За перших після революції часів позбавлення волі регулювалося революційним звичаєм. Згодом з’являються перші пенітенціарні закони, а з часом постає необхідність їх кодифікації, створення Кодексу. Так на початку 20-х років XX століття відбувалося зародження та становлення кримінально-виконавчого права у новостворених радянських республіках, насамперед у РРФСР, де вперше було розроблено, обговорено і прийнято Кримінально-виконавчий кодекс, який став взірцем для відповідних Кодексів в Україні та Білорусі. І. Малиновський на час розроблення, обговорення і прийняття ВТК РРФСР перебував в ув’язненні в Москві. Тим не менше він як учений і в’язень, який досконало знав пенітенціарну систему того часу немов би «із середини», написав і надрукував наукові статті про проєкт цього ВТК і вже прийнятий Кодекс. Його зауваження та пропозиції до проєкту були тією чи іншою мірою враховані, а зауваження щодо змісту ВТК враховані також і надалі. Загалом вони і нині деякою мірою не втратили своєї актуальності.

The article considers the conditions, the time of the creation of the first Soviet Corrective Labor Codes, in the first place Corrective Labor Code of the Russian Soviet Federal Socialist Republic, and the participation of I. Malynovskyi in the scientific discussion of his project and scientific-expert evaluation of the already adopted Corrective Labor Code at the time when he was a prisoner. The reason for the emergence and formation of the new Soviet law, including criminal executive law, the scientist named the fracture of the old social order and the destruction of the old law by the revolution of 1917. The new system demanded adequate rights. In the first post-revolutionary times, imprisonment was governed by revolutionary custom. Later, the first penitentiary laws appeared, and over the time there was a need to codify them, to create a Code. Thus, in the early 1920s, criminal executive law was born and established in the newly created Soviet republics, primarily in the Russian Soviet Federal Socialist Republic, where the Criminal Executive Code was first developed, discussed, and adopted, which became an example for the relevant Codes in Ukraine and Belarus. I. Malinovskyi was imprisoned in Moscow during the time of the development, discussion, and adoption of the Corrective Labor Code of the Russian Soviet Federal Socialist Republic. Nevertheless, as a scientist and as a prisoner who knew the penitentiary system of that time, as it can be said “from the inside”, he wrote and published scientific articles on the project of this Corrective Labor Code and the already adopted Code. His comments and suggestions on the project were taken into account to some extent, and according to the content of the Corrective Labor Code were taken into account in the future. In general, they have not lost their relevance to some extent today.
