Система забезпечення митної безпеки в Україні

Abstract

У статті забезпечення митної безпеки досліджено як складне явище на основі системного підходу. Систему забезпечення митної безпеки розглянуто як єдність, цілісність таких закономірно розташованих і взаємопов’язаних компонентів, як цільовий, об’єктний, суб’єктно-організаційний, результативний. Цільовий компонент представлено метою, з якою створюється ця система, а саме: реалізація економічних і безпосередньо митних інтересів і нівелювання відповідних загроз і небезпек. Об’єктний компонент схарактеризовано як сукупність таких елементів: предмет – митні інтереси (об’єкт загроз, на забезпечення безпеки яких і спрямована відповідна система); суб’єкти / носії митних інтересів (людина / громадянин, суспільство, держава / регіони); загрози й небезпеки митним інтересам, які охоплюють джерела й носіїв загроз, своєчасне виявлення та повне усунення яких є умовою досягнення митної безпеки як стану захищеності митних інтересів. У рамках суб’єктно-організаційного компонента системи забезпечення митної безпеки умовно виокремлено два елементи: організаційно-інституційний (сукупність певним чином організованих суб’єктів, уповноважених брати участь у формуванні й реалізації митної політики); організаційно-функціональний (функції, компетенції та повноваження цих суб’єктів). Правові заходи управлінського впливу на митну справу в рамках суб’єктно-організаційного компонента системи забезпечення митної безпеки систематизовано у дві групи: регулятивні й організаційні. Акцентовано, що досягнутий результат функціонування системи забезпечення митної безпеки має корелювати з метою, що дозволяє встановити рівень дієвості системи й визначити напрямки її удосконалення. Систему забезпечення митної безпеки в Україні презентовано як відкриту й динамічну, розвиток якої детермінується визначеними чинниками.

Software customs security in the article is investigated as a complex phenomenon based on a systematic approach. The system software of customs security is considered as the unity, integrity of such naturally interconnected components, as: target, object, subject-organizational, effective. The target component is represented by the goal, for which this system is created, namely – realization of economic and directly customs interests and leveling of the corresponding threats and dangers. The object component is characterized as a set of the following elements: subject – customs interests (object of threats, the security of which is aimed at the relevant system); subjects / holders of customs interests (person / citizen, society, state / regions); threats and dangers to customs interests, which include sources and carriers of threats, timely detection and complete elimination of which are a condition for achieving customs security as a state of protection of customs interests. Within the subject-organizational component of the customs security system, two elements are conditionally distinguished: organizationalinstitutional (a set of organized entities authorized to participate in the formation and implementation of customs policy); organizational and functional (functions, competencies and powers of these entities). Legal measures of administrative influence on customs within the subject-organizational component of the customs security system are systematized into two groups: regulatory and organizational. It is emphasized that the achieved result of the functioning of the customs security system should be correlated with the goal, that allows to establish the level of efficiency of the system and to determine the directions of its improvement. The system software of customs security is presented as open and dynamic, the development of which is determined by certain factors.
