Підстави перегляду судових рішень за нововиявленими обставинами

Abstract

У статті викладено наукові результати аналізу положень нової редакції Цивільного процесуального кодексу України та надано оцінку підстав перегляду судових рішень за нововиявленними обставинами, а також проаналізовано, чому ці обставини вважаються нововиявленними. Сформульовано пропозиції щодо вдосконалення положень цивільного процесуального законодавства щодо перегляду судових рішень за нововиявленими обставинами.

The article presents the scientific results of the analysis of the provisions of the new wording of the Civil Procedure Code of Ukraine and provides an assessment of the grounds for reviewing court decisions in newly discovered circumstances, and also analyzes why these circumstances are considered newly discovered. Suggestions are made to improve the provisions of civil procedural law for reviewing court decisions in newly discovered circumstances. The legislator in Part 2 of Art. 423 of the CPC establishes an exhaustive list of grounds for review: – material circumstances of the case that were not established by the court and were not and could not be known to the person who filed the application at the time of the case; – established by a verdict or decision to close criminal proceedings and release a person from criminal responsibility who has entered into force, the fact of providing, in the case of a known incorrect conclusion of an expert, obviously not true testimony of a witness, knowingly incorrect translation, false written or electronic evidence that led to not a legal decision in this case; – the cancellation of the judgment which became the basis for the adjudication to be reviewed. The list of grounds for review of court decisions on newly discovered circumstances, which is given in Part 2 of Art. 423 of the CPC of Ukraine is not subject to extended interpretation. A new court decision overturns the admissibility of the facts underlying another court decision, the question arises as to the review of a previous civil court decision. Since most of the time limits for the possibility of violating any other type of review have passed, there remains the only option - reviewing the newly discovered circumstances.
