Конфлікт та солідарність інтересів в умовах пандемії КОВІД-19

Abstract

У статті досліджуються проблеми теорії та практики залагодження конфлікту цивільних інтересів в умовах пандемії КОВІД-19. Інтереси є однією з базових категорій цивільного права. Проблема їх конфлікту та залагодження, а надто з’ясування можливості солідарності інтересів набуває особливої актуальності в умовах надзвичайних ситуацій, зокрема, епідемій /пандемій. Оскільки публічні засоби впливу у цій сфері виявилися недостатньо ефективними, актуальним є також вивчення ролі громадянського суспільства у стосунках, які при цьому виникають. Для досягнення зазначеної мети у статті аналізується поняття та сутність категорії «інтерес» та її співвідношення з категорією «суб’єктивне право». Розглядається поняття «конфлікт інтересів» та чинники такого конфлікту. Зазначається невиправданість ігнорування концепту «солідарність інтересів» та ідеї солідаризму з погляду використання цієї ідеї для залагодження (ліквідації) конфлікту інтересів. Розглядається значення громадянського (цивільного суспільства), як конструкту солідаризму, для залагодження конфлікту цивільних інтересів в умовах кризи, зумовленої пандемії КОВІД-19. Екстремальні умови буття суспільства, зумовлені пандемією КОВІД-19, створюють підґрунтя загострення конфлікту цивільних інтересів, що створюють загрози як у приватній, так і публічній сферах. Зазначається, що спроби подолати ці загрози за допомогою публічно-правових засобів не є ефективними, про що свідчить і практика їх застосування під час карантину (локдауну). Разом із тим, і суто приватноправовими засобами залагодити ці конфлікти, як стало очевидно, неможливо. На підставі критичного аналізу матеріалу робиться висновок, що найбільш ефективним засобом подолання конфліктів інтересів, які виникають у кризових умовах, є використання ідеї солідаризму (солідарності інтересів), що є можливим за допомогою громадянського (цивільного, громадського) суспільства, яке, власне, є втіленням згаданої ідеї.

The article examines the problems of theory and practice of resolving the conflict of civil interests in terms of the COVID-19 pandemic. Interests are one of the basic categories of civil law. The problem of their conflict and settlement, and especially the elucidation of the possibility of solidarity of interests, becomes especially relevant in emergencies, in particular epidemics / pandemics. As public means of influence in this area have proved to be insufficiently effective, it is also relevant to study the role of civil society in the relationships that arise. To achieve this goal, the article analyzes the concept and essence of the category interest and its correlation with the category of subjective law. The concept of “conflict of interest” and the factors of such a conflict are considered. It is noted that it is unjustifiable to ignore the concept of solidarity of interests and the idea of solidarity in terms of using this idea to resolve (eliminate) conflicts of interest. The importance of civil society as a construct of solidarity for resolving the conflict of civil interests in the crisis caused by the COVID-19 pandemic is considered. The extreme conditions of society caused by the COVID-19 pandemic create the basis for the escalation of the conflict of civil interests, which pose threats in both the private and public spheres. It is noted that attempts to overcome these threats through public law are not effective, as evidenced by the practice of their use during quarantine (lockdown). At the same time, it has become obvious that it is impossible to resolve these conflicts by purely private law means. Based on a critical analysis of the material, it is concluded that the most effective way to overcome conflicts of interest that arise in crisis situations is to use the idea of solidarity of interests, which is possible with civil society, which is actually the embodiment of the mentioned idea.
